2. Scope of these Terms

These Terms and Conditions govern access to and use of the UYUL ATLAS website and platform. They apply to all users, including account holders, clients, administrators, invited users, and viewers to the extent relevant to their access level.

3. Acceptance of the Terms

By registering for, accessing, or using the platform, the user agrees to these Terms and Conditions and the Privacy Policy.

4. Registration and mandatory email-based account use

To register, log in, and use the platform as an account holder, the user must provide and maintain a valid email address. The user agrees that email-based identification and authentication are required for account creation, login, access management, and service-related communication.

The user must keep registration information accurate and up to date.

5. Account security

Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their account. UYUL UG may suspend or restrict access where necessary to protect the platform, investigate misuse, or comply with legal obligations.

6. Platform roles, permissions, and access

The platform may provide different roles, access levels, sharing options, viewer rights, comment rights, and export or download permissions. UYUL UG may configure, change, restrict, or remove access rights where reasonably necessary for security, administration, product operation, or compliance.

7. Uploaded content and storage consent

By uploading any images, maps, files, comments, or other project content to the platform, the user agrees that such content will be stored and processed on infrastructure used by UYUL UG, including Microsoft-provided storage services as configured for the platform.

The user also agrees that the uploaded content may be stored, backed up, processed, displayed, exported, and made available within the platform as necessary to provide the service.

8. Backend visibility and technical access

By using the platform, the user acknowledges and agrees that UYUL UG may have backend visibility into project details, uploaded content, account-related data, and related technical information where this is reasonably necessary for:

  • technical support;
  • troubleshooting;
  • maintenance;
  • recovery;
  • security administration;
  • legal compliance.

9. User responsibility for uploaded content

The user represents and warrants that they have all necessary rights, permissions, and legal authority to upload, store, use, process, and share all content submitted to the platform. The user must ensure that uploaded content does not infringe third-party rights and does not violate applicable law.

10. Prohibited use

Users must not:

  • upload unlawful, infringing, harmful, or misleading content;
  • upload malware or malicious code;
  • attempt to bypass permissions or gain unauthorized access to other data or accounts;
  • interfere with platform security, stability, or availability;
  • use the platform for unlawful, abusive, or fraudulent purposes.

11. Hosting and third-party infrastructure

The website and platform may be hosted or operated using infrastructure and services provided by Lovable Labs Incorporated. Lovable publishes platform-level security and compliance information through its Trust Center, including references to SOC 2 Type II, ISO/IEC 27001:2022, and GDPR-related information and controls. Users may review Lovable's Trust Center here: https://trust.lovable.dev.

For hosting-provider-specific privacy or security information, users should also review Lovable's own trust, privacy, and security materials. UYUL UG remains responsible for its own app configuration, internal access practices, and customer-facing privacy handling.

12. Intellectual property in the platform

All rights, title, and interest in the platform, software, branding, interface, and related materials, excluding user-uploaded content, remain with UYUL UG or its licensors. These Terms do not transfer ownership of the platform itself to the user.

13. User content ownership and platform license

The user retains ownership of uploaded content to the extent the user owns it. However, by uploading content, the user grants UYUL UG the limited rights necessary to host, store, process, display, organize, back up, transmit, and make such content available within the platform solely for operating, supporting, securing, and improving the service for its intended purpose.

14. Sharing and viewer access

The platform may allow users to share projects, atlas views, files, comments, and exports with third parties according to permission settings. The user is responsible for choosing appropriate sharing settings and access permissions.

15. Availability and service changes

UYUL UG may modify, improve, maintain, suspend, or discontinue features of the platform where reasonably necessary for technical, legal, operational, or security reasons. UYUL UG does not guarantee uninterrupted or error-free availability at all times.

16. Privacy and data protection

Use of the platform is also subject to the Privacy Policy. By using the platform, the user acknowledges that account data, uploaded content, technical logs, and support-related access may be processed as described there.

17. Disclaimer

To the extent permitted by law, the platform is provided on an as available basis. Nothing in these Terms excludes liability where exclusion is not permitted under mandatory law.

18. Limitation of liability

Any limitation of liability clause should be reviewed by legal counsel before publication to ensure compliance with German law, mandatory consumer protection rules if applicable, and the specific business model of UYUL UG.

19. Termination and suspension

Users may stop using the platform at any time. UYUL UG may suspend, restrict, or terminate access where justified, including in cases of breach of these Terms, security risk, legal obligation, misuse, or operational necessity.

20. Governing law and jurisdiction

These Terms should be governed by the law applicable at the registered seat of UYUL UG, subject to any mandatory consumer protection laws that may apply. The final governing law and jurisdiction clause should be reviewed by legal counsel before publication.
